1) Eligibility and Accounts
- Age: the Service is intended for users at least 17 years old.
- Account info: you must provide accurate information and keep it updated.
- Security: you are responsible for safeguarding your credentials and activity on your account.
2) License and Relationship to Apple
These Terms are between you and BlineFlips Team, not Apple. Apple is not responsible for the Service or its content. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
Subject to your compliance, we grant you a limited, non-exclusive, non-transferable, revocable license to install and use the Service on Apple-branded products you own or control, as permitted by applicable platform terms and law.
3) What the Service Does
BlineFlips helps you organize and manage your lipstick collection by archiving lipstick shades, brands, and prices; comparing colors; saving favorites; tagging items; and recording where you found products.
Some features may optionally offer automated analysis of text or images to assist organization or comparisons. Use of such features is optional and governed by our privacy practices.
4) User Content
You may submit or store content such as text entries, photos, tags, notes, and support messages ("User Content"). You retain ownership of your User Content.
- License to operate the Service: you grant us a limited license to host, store, process, and display User Content solely to provide, maintain, and improve the Service, consistent with our Privacy Policy.
- Your responsibility: you represent that you have the rights needed to submit User Content and that it does not violate any law or third-party rights.
5) Prohibited Conduct
You agree not to:
- use the Service for illegal, harmful, abusive, harassing, or fraudulent purposes;
- access or attempt to access other users’ accounts or data without authorization;
- reverse engineer or attempt to derive source code, except where permitted by law;
- interfere with or disrupt the Service or bypass security measures;
- upload malware or harmful code;
- scrape or harvest information from the Service without permission;
- use the Service in a way that violates applicable platform rules, including App Store requirements.
6) Disclaimers and Limitation of Liability
The Service is provided "as is" and "as available" to the maximum extent permitted by law, without warranties of any kind. We do not guarantee uninterrupted, secure, or error-free operation, or the accuracy of any comparisons or automated outputs.
To the maximum extent permitted by law, BlineFlips will not be liable for indirect, incidental, special, consequential, or punitive damages. Our total liability will not exceed the amount you paid to BlineFlips for the Service in the 12 months before the event giving rise to the claim (or USD $10 if you paid nothing).
7) Termination
You may stop using the Service at any time. We may suspend or terminate access if we reasonably believe you violated these Terms or if necessary to protect the Service, users, or our rights. Upon termination, the license ends.
8) Governing Law and Dispute Resolution (Binding Arbitration)
These Terms are governed by the laws of the jurisdiction where BlineFlips Team is primarily established/operates, without regard to conflict of laws principles.
Any dispute arising out of or relating to these Terms or the Service will be resolved by binding arbitration on an individual basis, rather than in court, except that either party may seek injunctive or equitable relief to protect intellectual property rights. Where permitted by law, you and BlineFlips waive the right to participate in class actions or class arbitration.
9) Changes and Contact
We may update these Terms from time to time by updating the Effective Date above and, where required, providing additional notice through the Service.
